I-94 expiring, L1 extension being filed, should I travel on EAD/AP?

  • I-94 expiring, L1 extension being filed, should I travel on EAD/AP?

    Will appreciate any clarification for my situation.

    1. I am on L1A Blanket visa. I have had one extension already, I-94 for which is expiring end July 2019. I never left US after extension, so no visa was stamped.
    2. Company is about to apply for next I-94/L1 extension, all documents submitted from my side.
    3. I recently received my EAD/AP combo card which is valid till 2021.
    4. I am planning to travel out of US with family during summer holidays and return sometime in July. By that time I will NOT have my L1 extension done (company is refusing to apply in premium category), so no stamping possible.

    Q: Is it advisable to go ahead with the travel and return to USA on our EAD/AP cards while our extension request is in processing? A friend told me that for L1 visa holders, travel on EAD/AP is not advisable. He is not able to provide any rationale for this though.

    I don't know if you can go back to L1 if you enter the USA with AP. I hope someone else can give you more information.

    Edit: I found this on another site, don't know how current/valid it is:
    H 1B holder Re-Enter USA with AP status

    If you use AP to re-enter USA, your status on i94 will show as “Parolee” and i94 will be valid on for 1 year. You can ONLY work for the same H1B employer with which you had an H1B approval prior to leaving USA.

    You can change your i94 status again to H1B by filing H1B extension, Amendment or Transfer after entering on AP. Once H1B is approved, you will get a new i94 with status =”H1B Admitted“.
    I guess it also apply to L1 but I don't know. Sorry I can't give you a direct answer.

      If AP is valid for 2 years, would they still issue an I94 for just one year? How does one stay on after that then, assuming person continues to work on EAD and does not extend his L1/H1 visa?
