Trying to send in the 131 concurrently with 485 for my parents in law in next few days. Couple of question if anyone can help me with.
1. Read on instruction if I am filing a 485 the AP file is no fee? is that correct? What bout biometric? If I already paid the biometric in 485 do I pay again in131?
2. The reason why I am submitting the 131 is because just few days ago we were informed that my mother in law's mother (who is 84) is having health issues, doctors can't say if anything serious but as with any illness in advanced age you can't really say. But if it is something serious they need to be able to readly leave. So I thought if I can put in the 131 concurently with my 485. But it also ask for intended departure date, that unfortunately we don't know. It can be couple of month it maybe 6 month or more. We just don't know when she need to leave and how long she will stay? How do I fill the form? If i wait until he really needs to go back woudln't be too late?
3. Last question, they are currently on B2 visitor visa, both me and my wife are US citizen. They B2 visa run expires in May. Does that mean if they were to go out they have to return before may expiration day? or somehow the AP supersede the visa expiration date?
4. Also, why is there two section on name and address. do I fill out part 1? Since the person is within USA?
