  • Transfer H1 after filing 485 and EAD

    Hi All,

I am on H1B and have got an offer from another employer. I got married to a US citizen in Jan 2010 and have file my AOS and EAD and have got receipts for them.

My question: Can I transfer my H1 to new employer in my current situation as the new employer wants me to join asap.

    Thanks

YES you can transfer. You need the new employer to apply for transfer of H1 (almost the same process but you can start working as soon as your application is filed and received by USCIS). You can retain your visa as long as it lasts or until you get green card is approved whichever is earlier. BUt if you switch to EAD and need a visa for some reason...then you may have to get all new visa.....process...done....
