  • Advance Parole Help

I have a few hypothetical questions - would appreciate any insight anyone can provide

1- When you travel abroad with an advance parole, what is the
procedure when you are departing the US ? Do you return your I-94 at departure ? Do they stamp your advance parole ? How does CIS document you left the country?

What would happen if a person leaves the US - without handing in the I-94, and then gets the AP approved. Can this be sent in the mail?
How and would CIS know that he left before his AP was issued?
What could happen if they realize that ?

    Thanks for your help

    1. They do not stamp anything when you leave the country. You of course need to surrender your I-94. You will need to show the AP when you come back in (if you have to).
    2. You should ideally surrender the I-94 failing to do so may cause problems while coming back in. Do not know the answers to other questions.

If you are on H1B and I-485 is pending, you do not need to use advance parole. If you use it, your status changes to AOS (Adjustment of status). Unless you plan to use your EAD, do not use advance parole.
