1. I used to work for company A on H1-B since 2003. Company A also filed my Green Card thru PERM ( Priority date, Feb 2007). Subsequently my i-485 was filed in August 2007 and I got my EAD card in Dec 2007. My EAD card was later renewed for another 2 years and it is now good till Aug 2010. At the same time I always maintained a valid H1-B, and was always working based on my H1-B.
2. I changed employers and started working for company B in Sept 2009. Company B transferred my H1-B over. While my EAD is valid till August 2010, I did not use it.
3. Now company B has been acquired by company C. Company C has given me a choice to choose b/w H1-B transfer and supporting my EAD/AP.
a. They are ready to file for a H-1B amendment to transfer my H1-B to company C. They may even be willing to give me a letter
to confirm my eligibility for Permanent Residency portability.
or
b. Extend my EAD since it is expiring in Aug 2010.
They are NOT ready to do both....probably because of cost reasons ( sic... ). This is very weird, but I need to make a choice quickly.
If I have Company C transfer my H1-B ( option a.) can I file for extending my EAD/AP on my own when it expires in August 2010, or will I need company C to support me in my EAD extension application ?
I do not want to negatively affect my pending Permanent Residency (i485) application in any way and still maintain my H1-B, if I can.
Please advise what is the best course of action.
