EAD Denied after I129 denial

  • EAD Denied after I129 denial

    My L1-B was expiring on 30th March 2010, so I applied for my L1-B extension (I 129), L2 extension (I 539) for my family and EAD for my wife (I 765) all three together.

    Since my I 129 got denied, my wife's EAD (I 765) also got denial notice.

    Then my company applied I 129 & I 539 and again, this time under L1-A category - which has now been approved

    Can I re-open my wife's EAD case (old petition) or would she have to re-apply fresh? Would this process again take 90 days ?

    My wife called the USCIS office today and they suggested that she needs to apply a fresh EAD only (with another $340).

    I wonder if she'll have to wait for another 90 days or this time it can be faster? Could premium processing be applied to this case?

    Did anyone face the same situation?
