I just had an issue arise, which I know is bad but don't know what is the best move. My wife is on a J2 visa and has been working in the US for about 2 years (I have a J1). A few months ago we renewed our visas (my J1, her J2) and thought all was good, but only the other day realized that her EAD expired when our visas expired, and we never even realized it. So she has been working for a few months (about 6) on an expired EAD. I know this was our mistake, but wondering what is the best thing to do now. Either...
A) She stops working now and applies for a new EAD - the problem with this seems that it might draw attention to her working on an expired visa.
B) She keeps working and hopes for the best - we will probably only stay in the US another year or so and don't plan on renewing our visa's again, so hoping she won't get caught...Since she has already worked for quite a while on an expired EAD, it seems there is little harm now in continuing?
C) She stops working and doesn't work anymore (don't apply for new EAD), and hope that she doesn't get in trouble for the 6 months of illegal working.
Any thoughts? I wish we had realized this earlier, but the EAD expiration didn't even cross our minds.
