  • EAD/AP in married name and Indian passport in maiden name

Need to travel to India urgently. Just received my combo card and it is in my married name. My indian passport has my maiden name. Will I be given any trouble from Indian immigration in Mumbai when I leave to come back? Marriage based, so will carry our marriage certificate and my US citizen husband will be travelling with me.

    You shouldn’t have problems.

One question, can you change your Indian passport to show your married name? I know some consulates from other countries you can get a passport the same day, others take weeks, some allow name change and others just allow to put the spouse's last name on a special area. Good luck.

Thank you for responding! I could change it to my married name but I will have to leave here on Friday, I know the embassy will take longer to give it to me. Also I’m currently in the AOS period and my original passport details are mentioned on all our USCIS paperwork so not sure if it will affect anything if I change my passport? I’m just so concerned that they will refuse to see the AP as a good enough reason to let me travel back if it has my new last name. I will go to the Indian embassy here in DC tomorrow to see if they can give me some sort of notarised letter stating that I go by both names until my green card is approved.

Oh also to note, i have a valid B1B2 10 year visa that was issued to me a few years ago. It’s in my maiden name, same as passport. Should I just show that to Indian immigration if I have troubles with different name on AP?

Sorry, I don't know Indian immigration. Most countries only need a passport to enter. When you fly back they must check if you have the correct documents to enter the USA, showing a passport, AP and marriage certificate should be enough.

I asked about your Indian passport not to do it now, but when you get your GC. Most likely you GC will have your married name.
