Hello Sir/Mam,
I have filed vawa application. My husband was a US Citizen. And he has withdrawn my i-485 ,i-765, i-131 applications. USCIS has transfer my i-485 and hold it back. Now i want my work permit before getting approval of my vawa form i-360.
But below is the answer I get from VAWA help desk.
" It appears that a Non-VAWA related Application for Employment Authorization (Form I-765) was recently denied. If you would like to reopen that application, please see the appeal rights that were provided in the notice. You may also file a new VAWA related Application for Employment Authorization (Form I-765). "
I have three concerns:
1) I want my employment authorization before approval of vawa.
2) Can I file under (C)(14) category as I am married to a US citizen but filed vawa and having an economic necessity ?
3) Or still I can file under (C)(9) category ? Can I appeal to reopen my i-765, previously denied form as the denied notice mentioned that I can not appeal and 30 days already gone for appeal ?
