  • H1 6 year / EAD / AP

    The H-1B visa stamped in my passport with my old employer as petitioner expires in last week of Feb 2005. I am traveling to India in the 1st week of Feb. When I will be in India, I will get another H-1B visa stamped which would only be valid till mid-April 2005 since I-797A with new employer as petitioner expires on that date. This date is the expiry of H-1 6-year limit.

    I plan to re-enter the US in the 1st week of March 2005. EAD and AP shows as approved on uscis website for me and my wife. I have already scheduled my H-1 revalidation interview in India in Feb since at the time of scheduling the interview I had no idea about EAD / AP approvals.

    Will there be any problem in H-1 re-validation?

    When I would re-enter, since I would be using H-1B visa which would be valid for around 5 weeks then, will that be a problem for re-entry?

    I would appreciate all the help with these questions.
