  • I-485 EAD and advance parole

    Hi,

    I just recently submitted the application for I-485, EAD and advance parole. I am currently on a cap-exempt H1B visa (working in a university), and interested to work in industry on I-485 based EAD, hoping to receive it in the next 4-6 months. I would like to know how common is it among people to work on I-485 based EAD knowing the fact that if I-485 gets denied you'll be out of status. And if I-485 gets denied, how can it be handled so, that I can still remain in the US. I filed I-485 without attorney's help, so, a bit nervous to use I-485 based EAD. Any thoughts and suggestions would be much appreciated.

    I didn't know that you can file I-485 by yourself while working with H1B for a university, I always thought that the university needs to sponsor you and their lawyer must be involved.

      My I-140 was in EB-1A category. Therefore, my employer was not involved at all, other than providing me the current employment letter. Its all-through a self petition process.

      The one which you are thinking is EB-1B.
