Unknown Current Status

Hi,

I have downgraded to EB3 last october 2020. While my I -131, I 485, I-765 is still pending status and H1B Visa expired, I had to travel to india on an emergency. I spoke to infopass(USCIS) and got I-512 based on my pending adjustment status for travel. All my travel to India and back to USA is all good, I got my I-131 and I-765 approved while i was in India.

Now that i am in USA I am unsure what my current status is, with H1 visa Expired (but Approved H1B doc) and my I94 reads as parolee and having an approved Advance parole and EAD.

Hi Member,
You need to consider as GC EAD. Since you got EAD Approved and you dont have Nonimmigrant status, you can start enjoying GC EAD status.

You were paroled, so you are a Parolee. You do not have H1b status or any other nonimmigrant status. You can legally stay in the US, both before or after your parole expires, because you have a pending Adjustment of Status (I-485) application.
