  • E2 dependent EAD - USCIS policy change apply?

    Hi,
    I'm E2 dependent. My EAD expired in Sep 2021 and had to leave the job (renewal application sent in Mar 2021 and currently still pending)
    With recent USCIS policy changes for H4, L2 and E dependent, I was wondering if I'm eligible to work right now as I'm still in 180 days following
    my EAD expire date, with a valid I-94. Appreciate your advice!

    Yes, as long as your I-94 is unexpired and it's less than 180 days after your EAD expired. This page of the Handbook for Employers tells the employer how to complete the I-9, including special instructions "For Category Codes A17, A18, and C26".

      Thank you very much!
      While my case is pending, my I-94 and E2 has been renewed and now both of them have new expiration dates.
      Should I send these documents with new dates as additional evidences to USCIS? or shall I wait for RFE?
