  • EAD new rules

    Hi All

I heard the good news that EAD can now be automatically extended under certain circumstances one of them being having an unexpired I-94 so my question is, what happens if you're also waiting for an extension of I-94 with a I-539 filing?

    Thanks in advance.

    Then it doesn't help you

This is my personal opinion and is not to be construed as legal advice.

After reading a little more, it helps a lot at least after the I-539 is adjudicated, looking at processing times, it seems like I-539s are faster and in addition to that, when you file both I-765 and I-539, the I-765 is not processed until I-539 is adjudicated. Hope this helps people with my same question/doubt.

From USCIS: "For your convenience, you may file Form I-765 with Form I-539. However, we will not process your Form I-765 (except filing fees), until after we have adjudicated your Form I-539."
