  • EAD+AP or Green Card Interview directly?

    Hey Guys,

After a bureaucratic hell at USCIS that required me to request DHS Ombudsman to intervene, my wife finally did her biometrics interview on 12/28/21. We applied (in 2020) for the I-485 + I-131 + I-765 together but after checking some people complained their EAD+AP were skipped and they went directly for the Green Card interview.

Additional information: because of the USCIS system issue and one year until solving everything, our priority date for the EAD+AP was February of 21. Theoretically, she should get her AP+EAD very soon but with all conflicting information I don't know what to believe anymore.

Can anyone in here shed some light on this matter?

    Again, thank you in advance.

Is hard to say. Some believe that USCIS doesn't even start the clock for the EAD until the biometrics, if this is true, then it doesn't matter if you applied a year ago if the biometrics were done recently. Good luck and I hope you get the EAD/AP soon.

I've read that, in theory, the AP and EAD start at the application, not on the biometrics but I was wondering exactly what you said, that they may only start it after the biometrics. I got my EAD + AP two weeks after the biometrics, but for my wife this is taking longer. (and her priority date was February 2021).

Does infopass still exists in USCIS?

I don't think infopass are available anymore or at least not currently.

Family/dependents cases can take more/less time than the principal applicant. From what I read you can do an inquiry about your EAD/AP if it is taking too long. You need to review the current dates available to do an inquiry.
