  • Applied for a new EAD under a new case

    My wife immigrated to the US as an asylee. We renewed her EAD during the end of August '21 we have since gotten married and filed her new paperwork for adjustment of status along with a new EAD under this new case. Will they still honor the renewal we filed under her previous case or is it considered void? I understand the wait times are excessive and id hate to lose the August 2021 priority date because its been several months already. She can't even renew her drivers license until we receive the I-797.

    Asylees should be able to get a driver's license. What state is she in?

      We are in Texas. All we have are 797C’s stating her paperwork is pending. I believe they want to see form 797 (not C) which states actual approval.
      In Texas you have to get a Real ID. I believe that falls into federal guidelines and doesn’t vary state to state. This is all very confusing

          Thanks for the reply its much appreciated but she doesn't have any of the required paperwork stated. She applied for asylum after she arrived so there is nothing on her visa or i94 that states asylee. All we have is an EAD that expires in 2 days including the 180 day extension and I797C's stating all her paperwork is pending.

            Has her asylum been granted, or does she just have a pending asylum application?

              Pending (I-797C) since 2017. Meanwhile we've since gotten married and applied for adjustment of status, I-130, new work auth, and the mountain of paperwork that goes with it. (basically two pending cases). So now we have a bunch of pending paperwork. im guessing our best bet is to hope her original work authorization we filed seven months ago under asylee will be approved and still considered valid although we filed a new case for her adjustment of status in January.
              Her original work auth was filed in a timely manner the gov't is really slow and making life really difficult
