EB2 priority date: July 2013. EB3 downgrade 2020; I 485 pending; Job changed in September 2021; H1B approved with new employer and I 485 Supplement J filed. Combo card received Feb 2022; Wife is also on H1B with I 485 (I am the primary) pending. Her H1B with the current employer is still pending but she has a valid I 797 from previous employer (Expires June 2022).
Plan to travel to Mexico for a week
Questions:
1.Can I use automatic revalidation (AVR) after travel to Mexico for a week and maintain H1 status? https://travel.state.gov/content/tra...evalidate.html
2. Can my wife do the automatic revalidation with H1 approval from previous employer (Current H1 still pending)?
3. If we use AP from the combo card - Will that affect her pending H1B application?
4. If we both end up using AP - Can we travel to India (I already have approval), get stamping and regain our H1B status?
