  • I-131 Advance parol

I was told by my attorney that I am able to travel abroad without my advance parol document approval and it won’t affect my application negatively, the AP will be denied, but I can travel again. Is this a new law? Is it reliable? Has anyone done it?

Do you have a currently unexpired Advance Parole? Are you currently maintaining H1b/H4/L1/L2 status?

This is my personal opinion and is not to be construed as legal advice.

I just applied for I-131 along with change of status (485), so it is pending. I am on H1B

If you are maintaining H1b status (i.e. you have been continuously working for your H1b employer, you have a valid H1b I-94, you have not worked outside H1b with an EAD, etc.) up until right before you leave the US, and you return to the US on an H1b visa, your I-485 is not abandoned, according to 8 CFR 245.2(a)(4)(ii)(C).
