  • EAD and H1-B confusion

    Hi,

    I have recently recd approval for my EAD (Emp-based GC). My H1-B is valid under March 2010.

    Q1. Now that I have my EAD, do I need to apply for H1-B renewal? I do a need status correct?

    Q2. Is by H1-B considered abandoned once I start using EAD? What status will I be in if H1-B is considered abandoned?

    Q3. Can I work for my current employer on H1-B and simultaneously work for a different company on part-time basis using EAD? Any conflicts?

    Q4. If I use my EAD and my GC is rejected, can I go back on my H1-B status? depends on answers of Q1 and Q2..

    1. Good to have H1b renewed. AS your H1b has already expired in March 2010, if your 485 was filed before that, you are a parolee now and should only be working using the EAD.
    2. Parolee is your quasi status. No longer on H1b if EAD is used.

      Correction. My H1-B expires in March 2011.

        I am still a little confused on the answer for my 3rd question. Also, I did read the link you provided. Can you please clarify a little more.

        My old question:

        My new question

        If I use my EAD for my other job, can I still be on H1-B with my sponsoring employers? or will I lose my H1-B status if I use my EAD for my part-time job?

          You use EAD with both and you are no longer in H status and become a parolee. Read the H1b vs EAD comparison on immihelp.
