Need your suggestion on below scenario:
I am on H1B with approved i140 working for Company A.
Applied H4-EAD for my spouse based on my approved petition with Company A.
Company A petition for H1B & H4 is valid till 2024.
While H4-EAD application was in process, I got a job offer from Company B after 2 months.
Company B filed H1 & H4 transfer together, H1 was in premium got approved in a week.
H4 transfer got approved in a month along with pending H4-EAD application.
Here comes the tricky part:
H4-EAD validity was given based on Company B petition approval end date (2025)
Due to some reason, I never joined Company B, but Company B has not revoked my H1 transfer yet.
In this situation, whether my spouse can keep working based on EAD expiration date given by USCIS (2025) or we need to contact them to get EAD expiration date corrected based on Company A petition expiry date (2024) ?
We are anyway planning to file H4-EAD extension along with H1B & H4 extension (Company A) in 2024.
