One of my friends working for a Big US company. He filed his H1b through that company on EB3. He joined the company in 2007. Now he is eligible to become Manager based on his performance but the company not promoting him because his labor was filed as a programmer Analyst.
The legal department told him he cannot be promoted to Manager until he gets his EAD. Since he applied his GC on EB-I. It may take a while before he gets his EAD.
How can we convince the legal department? Anyone had faced this situation before ? Please help him out.
