EAD queries - when to apply, travel, H1 during EAD

Hi Folks,

I have few queries on EAD, can you please assist me?

#1 I have a L2 visa interview scheduled 1st week of april and planning to arrive at US in 3rd week of april. Can I apply for L2 EAD immediately after I arrive in the US? or should I wait for some time before applying it.

#2 Assuming I get the biometrics done in a month or two, can I then leave back to India and wait till the EAD arrives. Once EAD is through, I will come back to US. Is this possible or will there be any issues because I'm not there in the US while they are still processing my EAD?

#3 And a last question, Can I initiate H1 visa while am on L2(w/wo EAD)?

1. Yes
2. No. You need to be maintaining valid L2 status for EAD to be approved. If you leave the country, you do NOT hold a status.
3. Sure can provided the quota is still open and you have a job.

Hi Folks,

I have few more queries. My passport expires in May 2012, am currently in India and have a L2 visa. I'm travelling to USA in April.

#1 What will be the duration of my I94? Will it be till L2 validity or till passport expiry?

#2 I guess EAD validity also will be till I94 expiry?

#3 Since my passport is 10 years old and expiring, I guess I have to get a new one issued through Indian embassy. In that case, will my EAD still be valid or do I have to re-apply?
