Using AP on H1 status but no VISA

Please help.I am planning to visit India.I had H1 status till July 2012 but no visa in passport. I have also got the approved Advance parole travel document.(I485 pending) .I am bit concerning to go VISA in India.I wanted to use AP docment to returnto US.

1)What will happen to my H1 status if i returned to US with AP?
2)Will my spouse get H4 visa after marriage?

In my opnion if you enter as a Parolee, your status will no longer be H1 and so your spouse will not be able to enter as H4. So you need to get an H1 visa from a US consulate/embassy in your home country.
