I have sent a complete application including 130, 485, 765 and 131 by virtue of being married to a US citizen in August 2011 .
I am currently under H1B and my I-94 shows an April 2012 expiry date .
UPS ( the carrier ) shows that all my documents were delivered on November 15th 2011 to the Chicago lockbox facility.
I haven't received any acceptance / confirmation from USCIS and the checks haven't been cashed as yet.
Unfortunately, I have been laid off as of November 15th as well. I am presuming that my company will cancel the H1B assigned to me
My questions are :
1. Am I immediately considered "out of status" ? I cant leave the country , I have a family here.
2. Will USCIS deny my application for EAD / AP because technically my H1B stands cancelled? Please explain .
2. If USCIS does process my EAD/ AP , can I travel internationally under this parolee status pending the receipt of Permanent Residence status .
