  • Travel Plan & Advance Parole

    HI,
I am new to this forum. Please help.

Current H1B Visa (6th year), I-94 and Visa Stamp - All are Valid until March, 2012.
H1-B Visa Extension beyond six years - Applied in Nov, 2011 - In Processing.
    Approved I-140 EB2-I With PD- December, 2007.
I-485 AOS - Will be current from 1st December.- Planning to apply in December, 2011.\

As per December Visa bulletin, my PD will be current from 1st December, 2011. Currently I am in a process of filing I-485 AOS in December. I have an international travel plan to my home country in February. Please note that my current H1-b and visa stamp will still be valid by the time I return back to USA (i.e., end of Feb, 2011) - expires in march, 2012 at least a week before I return. By seeing current processing times, I am hoping that my H1-B Extension processing may be completed by January - that is much before I depart from USA.

In this scenario, I have few questions, please help me by answering to my questions.

    1. Should I apply for Advance Parole (I-131 FORM) along with I-485? If yes and if I don’t get AP approval by the time I want to return back, Will it be an issue?

    2. If I don’t apply for AP along with i-485, Can I return back with H1-b and then apply for AP while AOS is pending.

    3. For example, Let us say, if I get h1-b extension approved and later I-485 denied, Will my h1-b approval also be revoked since extension was approved based on I-140?
Please let me know, your help is highly appreciated.
