  • H4 issued H1-B but no job

    Hello,

I have a general question about my visa status, my husband is currently on a H1-B and his green card processing is under way, awaiting I-485.

I came to the US in May 2013 on H4 visa (stamped in India), this year a company applied H1-B for me based on which I applied for a SSN (issued already). Unfortunately this company has not been able to place me in a job even though my H1-B started on October 1 2014. I have a few questions regarding this,

1.) I heard that H1-B status grants a 2 month grace period during which the person may remain without pay or job, is this true?

2.) If I left the country and returned back before November 30 (end of her 2 month grace period) on my H4 visa with a new i94, then the H1-B becomes dormant and I can continue to be on H4 status up until a later date when I can find a job, is this correct?

Your advice is very much appreciated.

    1. There is no such 2 Month grace period.
    2. You seem to be out of status, and your employer is not paying you. I see this as the best option for you to get back into status.

And do try to change the employer as this one does not seem to be genuine.

This is my opinion not legal advice.

Can you help me out with the Company / Consultant

      Hi Rashmi,

Perhaps the best thing (at least in my opinion) is that you landed up with the H1B which is pure luck these days considering the quantum of applications received each year.

I am actually trying for consultants/companies who can file for my H1B as I am currently on H4 ,and trying as much as I can to get references for good consultants around considering there are a lot of impostors around.
Can you give me references of the companies which can help me with this?

Your help will be highly appreciated.

      Regards,
      Nishit Gherwada.
