  • Job consultant threatening on not accepting offer

    Hi All,

    Need urgent help here.
My job consultant X was proposing me to one of his client company(Y) and for that they had a Right to Representation letter signed from me, which included below wording apart from Right to represent clause:

"Resource agrees on the salary as mentioned in the offer letter (Negotiable). Based upon resources' commitment, we make formal legal commitments to the clients. Resource (i.e. myself) agreed that once he makes a commitment, he will fulfil it, whether to appear for Interview or to start a new project / assignment at the agreed place and time. Failure to fulfill the commitment will result in legal action & cash penalty."

With this he proposed me to his client, where I was interviewed and selected. During the negotiations I sent one mail to this job consultant saying, "I will be OK to join at X salary & Xx designation".
The company (this consultant's client) sent me an offer letter with the same X salary & XX designation. However, before that I received a better offer both in terms of salary & designation.
Now, this job consultant is threatening a legal action based on the form signed by me.
    Is consultant's point legally valid?

Note: I HAVE NOT ACCEPTED THE OFFER released by the company, and instead told them that I have a better offer.

Please advise urgently...looking forward to valuable suggestions.

    Thanks

    Consult a labor lawyer.
This is my opinion and not legal advice.
