Kindly suggest me, advice me on the possible implications.
Here is my situation. I am currently working on a project, the structure here is
My employer (A) -> Layer1 (B) -> Layer2(C) ->Prime Contractor (Big 5) -> Client
My employer A has a dealing / agreement with Layer1 (B) on me.
Layer1 (B) and Layer2(C) might be having another agreement that I am not aware of.
Layer2(C) and Prime Contractor (Big 5) also might be having an agreement.
Because of my green card / immigration reasons, I would like to shift my employer (A), applied for a H1B transfer with a new company (X) and would like cut short the layers in between, with project and position being the same.
As a H1B holder / as an individual, I am not having any signed agreements / obligations directly or indirectly with any of these above mentioned Layer1 or Layer 2.
I am thinking of a situation as
My New Employer (X) -> Layer 3 (Y) -> Prime Contractor (Big 5) -> Client
In this case I am reducing 1 layer, with the new employer I am having my GC processed, and Layer 3(Y) can pay a better rate to X.
I have good terms with Layer 3 (Y) and expressed about my interest. X and Y are fine to have the new change.
Now, the situation here is Prime Contractor (Big 5) quotes a statement that “This position where I am currently working on, Layer2(C) is the holder”.
Prime Contractor (Big 5) thinks that there may be a possible complication from Layer2 (B), about holding this position and may think of replacing with another person when they realize that I am no more with them.
What could be the possible threats that Layer2 (B) can create to Prime Contractor (Big 5) or to me individually with regard to this change?
Do we need to be careful on any matters and be prepared? What could be a suggested approach? I want to continue on the same project / position and do not want to disturb my life.
My H1 B transfer with New Employer (X) has been approved and he is now in a hurry to get me joined to his company. I would request any one to kindly advice me on my situation and suggest me the possible way to think.
