  • Employer caught by US Department of Labor

    My former employer has been found guilty of violation of Immigration and Nationality Act.

    They did not pay the wages for a H1B worker and were forced to pay the wages by US Department of Labor.

    What power does the US Department of Labor have with respect to the violating company?

    DOL can stop approving LCAs for the employer and force them not to employ H1b employees. They could even ban them from doing any business after repeated violations. They could notify DOS of the employer credentials which means visa rejections.

      These people are unscrupulous people and suck the bloods of the H1B aspiring candidates by changing the name of the company. The aspiring H1B candidates are to be more careful in selecting their prospective US employers. Otherwise, you have to break your head to guide them. I am sorry but this is the truth.

            Ah! Bribes!

            Well, you can try to pay a bribe anywhere, even in the United States.

            Now whether it will work or not depends on numerous variables.

            Why get into something that's beyond a normal person's reach?

            If the employer comes scoot free you'll always claim they bribed someone or some department.

            You can surely do a lot for the cause. Publish the information everywhere. Make sure the media gets a hang of it. Keep up with DOL and USCIS and get the reports from them on the final outcome.

            If everybody follows up properly, sooner or later the company will have to fold up.
