Employer has not paid salary for 3 months

I have been working for my employer on EAD (I9). My employer has not paid me since last 3 months. I have been working as technical recruiter , initially employer told me that they are facing certain crisis but would settle all dues in the next few days but now he is closing the office. Has started avoiding my ph calls / emails as well.
Please advise , any help will be appreciated.

Complain to your state department of labor. You need to be paid and employer owes every penny and they will get it back for you.

Should I go to DOL or small claims court.
Meanwhile I have the pay stubs only from Jan to July'08. Also I do not have the offer letter.

Should that be a problem.
Also what kind of proofs (paper doc's) should I require when I go to DOL or small claims court.
