    I worked for a consulting company on 1099 using EAD. They paid me while I was on project and but not for the last time sheet I submitted on the last week of my project.

    when I asked, They started talking about the client has not paid to them and I will be paid soon. They are telling this for last 45 days.

    Is the WH-4 form a right one to report about the non-payment for my case?

    And on which state should I complain, when the consulting company is in VA and client was in IN. I am also in IN.

    Do I need to consult an attorney to take legal action against the company other than reporting to DOL?

    Please advise me.

    I will reveal the company name once I confirm their attitude by 500%.

    Yes, use WH4 and complain to DOL. They have to pay you irrespective of client paying them.

      Employer not paying

      I complained about it to the vendor and they talked to my consulting company and it was settled. I thanked a lot to the vendor company.
