Non-payment of Salary

I am working for a non-profit organization in California on H-1 visa. Due to lack of funding, the organization has not been paying my salary regularly and I am owed at least 5 months of salary since Feb 2009. Now I am hearing that that organization may file for bankruptcy.

What options do I have to get paid my salary? What are the avenues that I can pursue so that I get some money that is owed to me?

You need to complain to DOL on a WH4 form. If they file for bankruptcy, you are outta luck and will land up in a queue with the bankruptcy court.
