I have been deployed in Australia for the last one year in a Managerial position. The firm in Australia is an affiliate of the US firm I have been part of since 2005. The US firm plans to get me back to the US in May 2013 in a Managerial position and file for my GC under EB-1. My wife works for the same firm in the US on an H-1B visa. I am planning to resign from my current job and travel to the US on an H-4 visa.
I wanted to understand if I travel to the US on an H-4 and the US firm then files for a work visa (H-1B or L-1A) while I am in the US will have any negative impact on my GC process? Or that I would be without a job in the US for 2 - 3 months before I start work again would have any impact on the GC process later?
