So i started my EB3 case few years ago with a priority date of JAN 2008. Last year i was promoted to an EB2 position so i refiled my green card application. Unfortunately i was randomly selected for audit during PERM. My attorney told me that the DOL has not even asked for my resume. I was also told that even if my EB3 date is current i cannot file my I140 and I485 because of the audit. Does anyone know if there is a way around this or my case cannot move forward until my PERM is approved? Thank you.
