EB3 not ported to EB2. USCIS rejected I-485 and returned all papers

Hi,
I really need help in my case and what is my next step. Really appreciate quick response since i need to apply i-485 before date gets retrogated.

EB3 PD date was Aug 2007
EB2 PD date was Mar 2012 (USCIS not ported EB3 date to EB2)
Both has same Alien number (A#) and both cases are from same employer

My company sent letter 3 times to USCIS to port date but haven't received response

As you know date has moved to Jan 2008 this month (Aug 2013) and my company filed I-485 with a request letter stating that i have EB3 and port my date to EB2.

USCIS has rejected my I-485 filing and returned all my papers though mail

As per my read in the forums, it is mandatory that USCIS has to accept old priority date and it is a LAW. What is my situation now ? How can i resubmit I-485 one more time to USCIS without having one more rejection and what type of supporting information i need to provide ? My employer tried all the options. is there any option available ?
