Hello all,
I have a query on eligibility for EB1 category for GC filing.
I worked as a software engineer in an MNC (say X) in India for 5 years. I was a manager when I left the company X. Before that I have another 5 years of work experience and post graduation from a reputed institute.
I resigned from X and came to U.S on H1B visa and joined a company Y. I worked for 1 year in this company and then moved to a different company (say Z). I am working in this company from last 2 years.
Its been 3 years and 1 month after I left the company X in India. Now the company X, want to take me back to their U.S office. They want me to join them as a Senior Manager.
My question, will i be eligible for filing green card on EB1 category. The information over internet specifies that i should go back to the company X, with in 3 years. Now that i cross 3 years by 2 months, should i be eligible or not ? Also, should i be required to join company X on L1-A or H1B ? does the visa type matter ?
