Can some one please shed light on the below scenario. I just learnt that the EB2 PD as advanced to January 2009. Here is my scenario;
My PD is January 2009 and I had my I-140 approved when I was with Employer A and was waiting,
In 2012 I decided to move to Employer B and had my labor filed in December 2013 (which is still to receive an answer from DOL) my Idea was to have the PD ported from my previous I-140 when I am at the stage of applying I-140 with Employer B.
I would like to know since my previous PD has become current, can I still use the PD when I apply to I-140(express process) under Employer B or will my PD now become December 2013 ? Is my previous PD still valid and can I port it when applying I-140 with my current employer (Employer B) ?
I would really appreciate if any one provide some inputs on the above situation.
