I have an approved I140 on Schedule A, Group II) in Aug, 2010, it was in the EB-2 category.
Based on my SAGII, I also filed EB3’s I140 and AOS this March since EB3C was current before June. Today, my EB3 I140 got denied based upon a requirement for Labor Certification by DOL.
But my approved SAGII exempts Labor Certificate, but presumably applicant is qualified.
To save my AOS validity, I would desperately need your suggestion on how I can appeal my EB3 case in order to keep my EB3 in pending condition. Once my EB2 becomes current, I can re-link my AOS back to my approved SAGII case.
