L1 A extension - RFE'd

Hi.
I'm new to this forum and appreciate your assistance for my query. I'm on L1-A for the last 3 years, and filed for the extension. My existing VISA and i94 will has expired in June 2014. My L1A extension has been RFE'ed and I'm in the process of answering the RFE.

My question basically is as follows:

1) Can my employer file GC for me in EB1(fast track) at this stage.
2) If answer to Q 1 above is YES, what would happen , if my L1A extension gets rejected before I reach the status in the 140 and again before I reach 485 documentation?

Appreciate your earliest response, as I have very less time to take action.

1. Yes they certainly can.
2. Depends upon your I-94 expiry, if your I-94 has already expired and L1A extension rejected you would have to leave US.
