EB2 or EB3

Hello Everyone,

My job position is Agile QA Lead. My Job requirement is Masters in Computer Science or equivalent + minimum 3 years of experience.
I have an MBA + 3.5 years of experience. My company's lawyer are saying that my GC cannot be filed in EB2 category because i don't have masters in computer science. Is there any argument on the basis of which i can tell them to file my GC in eb2 or i will have to file the GC in eb3 only?

Technically speaking, my subjective opinion is that Master in Computer Science or equivalent is NOT the same as MBA. In other words, I would not consider an MBA equivalent to a Masters of Computer Science.

That said, I would argue that you probably do not meet the job requirement. This could lead to issues at the time of filing I-140. Consult a lawyer.
