  • USCIS Medical Officer - Legal proceedings / Sue

    All,

Due to USCIS Medical officer / clinic ignorance and not filled up the medical form correctly 3 times , I had many issues during Green Card process and delayed by almost 2.5 years. Now , I have received the GC , but want to initiate the legal proceedings against them.

Please advise , are we eligible to do the same ? USCIS medical professional are immune from the legal proceedings of such nature ?

    Regards,
    Sonu

Screwups Happens at several levels untill we get the Card.

--->USCIS dont update the address inspite we fill the AR-11 and tie to the pending petition
----> USCIS sending the documents and Card to the wrong address and it gets returned back because of no fault on us(Its tedious job to get it back)
-----> Screw up by doctors (as in case of what u encountered)
-----> Screw up by USPS in delivering (Not delivering , getting lost and sevral issues)

But i like the idea of yours giving it back to them a punch.....

You can complain to USCIS about the USCIS-listed civil surgeon not completing your medical exam paperwork correctly....but USCIS is not at fault.

If your complaint is that your immigration procedure processing was delayed because of mistakes by the doctor, then your complaint is against the doctor.

But unless it is an issue of incorrect medical treatment, your complaint isn't going to amount to anything more than an apology from the doctor (if even that).
