  • H1B manager eligibility for EB1

    Guys,

    I am holding H1b and moved to US from 1 month and currently working for big US based IT company as IT project manager. For the same IT company i worked as project manager in india for more then a year before moving to US and i handled projects and team of 10-15 member during my tenure in india to compay's india branch. Currently in US i have 2 direct reportees.
    Am i qualifing for GC under EB1?

    I heard that only L1A visa holders can only apply for GC under EB1 category. Can H1B immigrant also apply for GC in EB1 category if they are fitting & fullfilling criteria of EB1 multinational manager?

    Answer to your first question is: unclear, need more details. EB-1 is tough to get.

    Answer to question 2 is: yes. It doesn't necessarily matter that you are currently in H-1B. You may well qualify. It's just that L status more clearly reflects status as multinational executive.

      I have one more query that i am fulfilling all other needs of EB1 and having 11 yrs of IT experience but i have 3 yrs bachalor degree from india. So will that be a problem? Is there any specific degree requirement for EB1?

          To be eligible under EB1C category, there are some basic requirements from educational qualification perspective as well. So there is a chance that your case might get delayed for processing. Also EB1C from H1B, while possible, happens rarely.

            Visa help?

            Me and my boyfriend are from Ireland. We currently work as construction engineers. I'm 23 and he's 25. In October 2016, we would like to go and work in San Francisco. I graduated in July 2014 and he graduated in July 2013. Im unsure if we qualify for a J1 visa and does this mean we need sponsorship with a hb1 visa before we can go?? His aunt is an us resident and we have adult friends who are us residents. Can they help? Any help is appreciated
