My h1b expires sept 2015 (in 6th year already)
EB2 gc filed may 2011 position "Sr SQA Engineer", I140 aprroved since Nov 2011
husbands H1b expires Jan 3,2016 EB3 gc filed dec 15,2014 Perm pending
I have opportunity to be promoted to SQA Manager of same team reporting to my same manager who is promoted to Sr Manager, Organization and company all remain same
Company is willing to file new greencard but will file only when EB2 India dates enter May 2010, they think it is unnecessarily early to file now
I have following questions
If I accept this new role what are the threats to my current h1B and GC process
I am in the 6th year of my h1B expiring Sept 2015 and I need renewal, would that be affected in any way? Company plans to renew H1b with old approved I140 for new position title "SQA Manager" Is that feasible?
Can I continue with the same I140 application after I switch to new role to file my I485
Or do we definitely need to file a new application ? Company is more inclined towards filing new one
Since there will be a limbo until we start the new application-Could it be a problem if my priority date becomes current at that time?
Do I get to keep my old date- does that mean my old application is still active? Company promises not to revoke it
Is there any way we could have the job descriptions converge and use the old PERM?
If we can't -Do we advertise a fresh one for the for the new job?
Are there are chances of audit too? And are we subject to the range in salary constraints for PERM filing etc all over again?
If the stars align (god forbid they do) and my date becomes current! and I am in a limbo where the new I140 is still not approved what happens then?
Is there anyway to express the new PERM/ I140?
Can I switch back to my old title to be able to use the old PERM and get my green card in case It becomes current and avoid the limbo? Or could I take title "Principal SQA Engineer Lead" and use old I140 for filing I485
Currently my husband is on his own independent H1B/Greencard queue ,however I am concerned since if there is a need I would like to apply for an EAD for my husband using the approved I140 (as per immigration reform)
As per AC 21 if I go to Principal lead title after 180 days can I come back to my SQA Manager title after I file I485?
Are there any travel restrictions during this period or would H1B stamping be a problem since new title is SQA Manager
