How H1B cap impacts GC
I spent 6 days less than 6 years on my H1B stint in US and am now back to India since Sep 2014. This makes me ineligible to apply for H1B in April 2015 and I can apply for it only after 31st Aug 2015. Assuming that the cap will be filled up fast I may not stand a chance till 1st April 2016 for H1B application.
Now, if a potential employer in US is ready to apply for my PERM and that the PERM and I140 is cleared THEN, can I apply for H1B outside the cap OR I still have to wait till April 2016?
