I am working for IT consultancy firm working in united states and have worked for outside USA office for 1.9 years. Have question related to EB1 C eligibility.
1) Does 365 eligibility condition says that an employee needs to be in managerial position in continuation for throughout 365 days with out any gaps? If an employee worked in outside USA office 9 months in one year and 5 months in another year, still he/she is eligble or not?
2) Does employee needs to have at least 6 or more reportees in outside USA office and US office? If he/she has 2-3 reportees on an average, still qualifies or not?
3) There is condition in "last 3 years.." in eb1 eligibility condition. What does this means? My employer isn't bothering for this condition, although I have been in USA for more than three years. Please help me in understanding these eligibility criteria s?
"You must have been employed outside the United States in the 3 years preceding the petition for at least 1 year by a firm or corporation and you must be seeking to enter the United States to continue service to that firm or organization. Your employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer."
