I am planning to start the GC processing with my current employer in EB 2 category. However, my situation is bit tricky and I would like to get suggestions from the experienced personnel with same situation or attorney monitoring the page.
I have done diploma in Mechanical from India, BS in Computer Science in US and just finished with Master of Business Administration concentrating in IT. I started my MBA in IT in March 2013 and I joined my current employer filing my GC in Feb 2014. Also, I completed my Masters in Feb 2015. According to my attorney since I was with the employer before I finished my MBA, I am not eligible to file my GC in EB2 category with this employer. Is this correct? I am not so confident with what lawyer wants to convey. How would it affect whether or not I was with the employer or not during my advanced degree program.
I have experience of working in US in the field of IT for the term of 2.5 yrs.

Also, if any one has faced same situation in past please describe it here so that I can better understand the situation.
