Hello Gurus,
My wife is in USA now on L2 visa and applied for EAD, finger prints are done on 9th June 2015. My company is processing me GC in EB-1C category and I have yet to complete documentation. I have few questions regarding including my family for GC processing. My family is going back to India in 3 weeks due to personal reasons.
1. While I apply for I-485, AP and I-140(company files it), can I also apply I-842 simultaneously for my family as they will be in India ? If yes, is EAD for my wife is valid or not while I-842 is filed/processing? Whether she can travel back to US on L2 visa and work using EAD? How long it might take to process I-842 for my family and when can they join me in USA?
2. Are there any other documents to be filed for including my family in GC processing in the above scenario ? what are the next steps after I-842 is approved?
3. If EAD is not valid while I-842 is filed/processing, do my wife need to apply for EAD again after getting GC?
4. What are the other options of bringing back my family to USA ?
