Eligible for EB2 or Eb3?

Hello,

My company is going to file my Green Card but i want to know am I eligible for Eb2 category for GC.

My question is related to my green card filing, I had 3 yrs of experience prior starting my current job, my company said the experience gained with this job could not be counted in the required experience.

1) Out of these 3 yrs, 1 yr experience I gained prior my Graduation, Will that count?

2) And I have done part time job parallel to my studies, will that also count in required experience?

3) Currently I am working as Software developer in X Company and that position has nothing to do with MBA, in this scenario will my post graduation help me as (grad+ p.g.+ 3yrs experience) and qualified me for EB2 category?

Education

4 yr Graduation (B. Tech)
2 yr MBA

Your qualification do not determine EB3 or EB2, job requirements do.

If the job requires Masters degree, it is EB2. You must of course qualify for the job. So if the job requires MS in Computer Science and you have an MBA, you don't qualify for the job so it does not matter.

Your employer's attorney will decide the appropriate filing. Ask them.
