Green card and FMLA
I am currently working in USA on H1B visa.
I have few questions regarding the Green Card process.
1. I am planning to to take 16 weeks of FMLA and STD starting January 2016. If my green card is filed before I go on FMLA, what would be the impact on green card process.
2. If my green card is not filed before January 2016, and I go on FMLA and STD for 16 weeks. Can my green card still be filed after I rejoin? Would being on FMLA and STD impact the eligibility criteria for GC?
3. There is a third case that I want to discuss. If I decide to take longer leave, and go on H4 for couple of months after FMLA and STD, and then join back work in July 2016. Will going on H4 impact the eligibility criteria for GC?
