Here is the situation
A was on H1B. And his I140 (EB II) is approved with PD June 2011. He died due to tragic accident.
To keep the petition open or to reinstate for his spouse B, we want to file Section 204 (I)
B has H4 till Jan 2016 which is extended till Jan 2019
What will be her status if reinstatement is approved ? Does she still remains on H4. Can she still apply for EAD for H4.
After re instating her immigrant visa petition using section 204 (I), can she change her status to B2 or H1B
Anyone please help
